Douglas County Precinct 25 House District 46

The measure would amend Section 1 of Article 5 of the Kansas Constitution to specify that in order to vote in Kansas, individuals must be citizens, at least 18 years old, and a resident of the area in which the person is seeking to vote in. However, the Kansas Constitution already states that eligible voters must be 18 years old, a citizen and resident of the area in which they will be voting.  This repetitive (already in the state constitution) and unnecessary (only citizens can currently vote) proposed amendment could be used to restrict voting by requiring proof of citizenship to vote.  

●   The language is vague—it does not state how a person will need to prove their citizenship (passport, original birth certificate, Real ID, all of the above?) or how often an individual will have to prove their citizenship (every election?).  Republican lawmakers will interpret this vague language to pass laws making it harder to vote. 

●   The amendment would disenfranchise many from voting—those who may not have or cannot afford the required documentation. 

●   The amendment would disenfranchise many women who changed their name when they married by requiring marriage and/or divorce documentation to validate the name change.

The Douglas County Democratic Party asks you to vote “NO” on this proposed constitutional amendment. The Kansas Constitution adequately specifies voter requirements that protects fair elections. We must not create confusion and mistrust in our voting system that advances needless voting restrictions. VOTE NO.

The Douglas County Democratic Party endorses voting NO on the November General Election Constitutional Amendment for the following reasons:

·         The Kansas Constitution adequately requires eligible voters to be citizens, eighteen years of age, and with specific residential and legal qualifications.

·         While this amendment appears to make no legal changes, it likely will cause confusion and partisan political attacks on voter registration and elections.

·         This constitutional amendment likely will weaponize partisan politics and advance restrictive voter registration laws.

The amendment is opposed by the ACLU of Kansas, the League of Women Voters of Kansas, and Loud Light Civic Action. Rashane Hamby, director of policy and research for the ACLU of Kansas: "The language in HCR 5004 could be weaponized to justify a return to restrictive voter registration laws, as it explicitly conditions voter eligibility on U.S. citizenship, despite no evidence of noncitizen voting in Kansas elections. Furthermore, the amendment’s reference to "laws of this state relating to voting for presidential electors" could allow legislators to tighten residency requirements or impose further barriers under the pretense of aligning with federal law. ... This constitutional amendment changes the language of the Kansas constitution from the federal default standard promoting everyone one who fits the following criteria are able to vote, to only those who fit these criteria may vote. This subtle but dangerous distinction promotes voter suppression through its exclusionary tone, instead of inclusionary and default language." BALLOTPEDIA
